These Terms of Use ("Terms") govern your access to and use of the Anchor mobile application and the stayanchored.io website (collectively, the "Service") operated by Anchor ("Anchor," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Anchor is a presence training application designed to help users practice returning attention to the present moment through short guided check-ins and related features. The Service is intended for general wellness and self-awareness support.

2. Not Medical or Mental Health Advice

Anchor is not a medical device and does not provide medical advice, diagnosis, treatment, or mental health care. The Service is not a substitute for professional medical, psychological, or therapeutic services.

If you are experiencing a medical or mental health emergency, call your local emergency number or seek immediate professional help. Do not rely on the Service for emergency support.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at info@stayanchored.io if you believe your account has been compromised.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose

  • Attempt to gain unauthorized access to the Service or related systems

  • Interfere with or disrupt the integrity or performance of the Service

  • Reverse engineer, copy, or exploit the Service except as permitted by law

  • Use the Service in a way that harms others or violates applicable law

We may suspend or terminate access if we reasonably believe you have violated these Terms.

6. Subscriptions and Purchases

Some features may require a paid subscription or in-app purchase. Pricing, billing terms, renewal terms, and cancellation options are presented at the point of purchase and are also subject to the applicable app store terms (Apple App Store, Google Play, or other platform).

7. Intellectual Property

The Service, including its content, design, software, trademarks, and branding, is owned by Anchor or its licensors and is protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8. User Content

If you submit content through the Service, you retain ownership of your content. You grant Anchor a limited license to use, store, and process that content solely to operate and improve the Service.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific needs.

10. Limitation of Liability

To the fullest extent permitted by law, Anchor and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

To the fullest extent permitted by law, Anchor's total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to Anchor for the Service in the twelve months before the claim or (b) fifty U.S. dollars ($50).

11. Indemnification

You agree to indemnify and hold harmless Anchor and its affiliates from claims, damages, losses, and expenses arising out of your misuse of the Service or violation of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles, except where mandatory local law applies.
